Customers using the various lessons (hereinafter referred to as "this lesson") provided by Waganooto Koryukan (hereinafter referred to as "this facility") shall take this lesson based on these terms and conditions. By applying to this facility for enrollment in this lesson, the customer shall be deemed to have agreed to the contents of these terms and conditions, and the terms and conditions concerning the use of this lesson shall be established between this facility and the customer.
Article 1 (Eligibility to Attend)
Customers who fall under any of the following categories cannot take this lesson.
- Individuals with abnormal health conditions such as heart disease, who are prohibited from exercising by a doctor.
- Individuals with infectious diseases and infectious skin conditions
- Pregnant individuals (unless they have obtained physician's approval to attend and have signed a separately specified consent form)
- Person with osteoporosis
- Individuals with injuries (unless medically cleared to participate and approved by this facility)
- Individuals with tattoos or traditional Japanese tattoos (including difficult-to-distinguish paintings, etc.) who wear clothing inside this facility
Those who refuse to cover tattoos and permanent markings, such as with bandages or stickers - Individuals associated with yakuza or other anti-social forces
- Additionally, any individuals deemed unsuitable as participants by our facility.
Article 2 (Customer Information)
Customers shall promptly notify the facility of any changes to their personal information, including their address, name, phone number, and email address (hereinafter referred to as "Customer Information"), which were provided at the time of application for this lesson. The facility shall not be liable for any damages incurred due to errors in customer information or delays in reporting changes.
Article 3 (Use of Customer Information, etc.)
This facility shall manage the customer information submitted by the customer with the due care of a good administrator, and shall not use or reproduce it for purposes other than those set forth in these terms and conditions, nor allow third parties to use it, nor disclose or leak it, except as otherwise provided in this article or elsewhere.
This facility will use your personal information for the following purposes.
- For the provision, management, and operation of this lesson
- To contact the customer regarding their participation in this lesson.
- for the purpose of providing information about various services, events, or seminars related to this lesson
Furthermore, we may disclose or publicize customer information to third parties if requested to do so by law, if it is necessary for legal procedures, or if we deem it necessary to protect the rights of our facility, other customers, or third parties. Upon receiving a request for disclosure, modification, or deletion of customer information, we will promptly respond after verifying the identity of the customer.
Article 4 (Prohibited Matters)
This facility prohibits guests from engaging in the following actions within the premises.
- Criminal acts against this facility or other guests, acts that violate public order and morals, or any other acts that violate laws and regulations.
- Acts that slander, defame, or damage the reputation of this facility or other customers.
- Actions that hinder the operation of the facility or interfere with other customers' lessons.
- Bringing dangerous items such as knives, firearms, or explosives into the facility.
- Damage to facilities, equipment or fixtures at our establishment, or removal thereof without authorization.
- Actions that do not comply with the facility's instructions
- Other acts that our facility deems inappropriate
Customers may not save, reproduce, distribute, transfer, or repost all or part of the videos related to this lesson (including captured images) (collectively referred to as "distribution, etc.").
If a violation of this clause is found, the facility will claim damages from the customer as stipulated in these terms and conditions, as well as a penalty of one million yen or twice the amount of revenue obtained through distribution, etc., whichever is higher, and will also take criminal charges or other legal measures.
Article 5 (Loss of Eligibility)
If any of the following apply, you will forfeit your eligibility to take this lesson.
- When a customer unsubscribes
- When a customer violates these terms and conditions, other rules or instructions set by the facility
- When a customer makes a false statement about their information
- When a customer violates the prohibited items of these terms and conditions
- When a customer passes away
- When this lesson facility was closed
- In addition, if this facility deems it inappropriate for you to be a customer.
Article 6 (Payment and Usage Conditions)
For single and multi-lesson packages, payment is processed at the time of booking.
For monthly lessons, payment is processed on the first day of the month of use.
The monthly tuition fee is non-refundable even if you do not attend the lesson.
Article 7 (Cancellation of this Lesson)
The Facility may temporarily close or shut down all or part of its facilities if the Facility determines that it is difficult or should not operate due to any of the following reasons: In the event of an earthquake, tsunami, typhoon, lightning, or other natural disaster, or if there is a risk thereof. In the event of the enactment, amendment, or repeal of laws and ordinances, or if there is a disposition (including disadvantageous disposition), administrative guidance, or order from an administrative agency. In the event of a significant change in social conditions, or if there is a risk thereof.
Article 8 (Cancellation)
Cancellations made up to 4 days before the lesson start date will not incur a cancellation fee. For cancellations made from 3 days before the lesson start date up to the day of the lesson, or for no-shows, the full lesson fee will be charged as a cancellation fee. If the facility decides to cancel the lesson due to an earthquake, tsunami, typhoon, lightning, or other natural disaster during the lesson, the fee for the affected lesson will not be charged.
Article 9 (Refunds)
This facility will not provide refunds for any payments made by customers, regardless of the reason, including the closure of this lesson facility, withdrawal of the customer, or any other circumstances.
Article 10 (Disclaimer)
This facility shall not be liable for any injuries, illnesses (including permanent disability), deaths, losses, thefts, or any other accidents occurring within the facility during this lesson, except in cases of willful misconduct or gross negligence on the part of the facility. Lost items will be kept for a certain period (1 month) and then disposed of.
Article 11 (Late Payment Charges)
If a customer fails to pay the lesson fee or any other amounts owed under these Terms and Conditions by the due date, the facility reserves the right to suspend the provision of the lesson and to demand payment of an amount equal to the lesson fee plus interest at an annual rate of 14.61% for the period from the day following the due date until the date of payment.
Article 12 (Damages)
Customers shall be liable for any damages caused to the facility or third parties due to their own negligence. Furthermore, in the event of soiling, damage, or loss of walls, floors, musical instruments, equipment, or fixtures within the facility due to customer negligence, the customer will be responsible for the cost of repair or cleaning.
Article 13 (Limitation of Liability)
The facility shall compensate for actual, ordinary, and direct damages incurred by the customer that are directly caused by the facility's intent or gross negligence. However, the cumulative total amount of such compensation shall be limited to the total amount of lesson fees paid by the customer to the facility during the twelve (12) months preceding the date the damage occurred. The foregoing shall be the limit of the facility's compensation and liability based on its responsibility. The facility shall not be liable for any damages arising from causes beyond the facility's control, nor for any special damages arising from particular circumstances regardless of whether the facility foresaw them, nor for any loss of profits.
Article 14 (Matters to be Observed)
- Smoking is prohibited within these facilities.
- Except for the first floor, shoes are not allowed in this facility.
- Activities, resting, sitting, and any other behavior in the shared spaces of our facility (entrance, stairs, landings, rooftop) are prohibited.
- There are no parking or bicycle parking facilities. Please refrain from parking or leaving your bicycle on the public road in front of our facility.
Article 15 (Cancellation due to instructor's reasons)
Lessons may be canceled due to the instructor's circumstances. In such cases, based on your preference, we will offer a make-up lesson or a refund of the lesson fee.
Article 16 (Changes to these Terms and Conditions)
This facility may change, add to, or partially abolish the content of this lesson (including the reservation system), the location of the lesson facility, the lesson fee, or the content of these terms and conditions without prior consent from the customer.
Article 17 (Jurisdiction)
All disputes concerning this lesson or these terms and conditions shall be subject to the exclusive jurisdiction of the Tokyo Summary Court or the Tokyo District Court as the court of first instance.
